Ante Nuptial Contracts

An ante nuptial contract (ANC), is a legal document that couples sign before getting married to regulate their respective rights and obligations regarding their assets, finances, and liabilities in the event of divorce or death.

This is crucial for parties to be married out of community of property.

When parties get married, they are free to choose their marital regime (see what the marital regimes are in South Africa) and if couples do not wish to be married in community of property, they must sign an ante nuptial contract (ANC).

An ANC allows couples to regulate if their marriage will be subject to the accrual system or not, and to customise their financial arrangements and protect their individual interests, ensuring clarity and certainty in the event of unforeseen circumstances.

We assist couples in drafting, reviewing, and executing ANC’s that are tailored to their specific needs and preferences, providing peace of mind and legal protection as they embark on their marital journey.

Cohabitation Agreements

A cohabitation agreement is a legal document that outlines the rights and responsibilities of individuals who are living together in a committed relationship but are not married.

They are an important tool in couples managing their joint and individual financial affairs before getting married.

These agreements are particularly useful for unmarried couples who wish to clarify their financial arrangements, property rights, and other important aspects of their relationship.

Cohabitation agreements can address issues such as property ownership, financial contributions, division of expenses, and support obligations in the event of separation or the death of one partner.

We assists couples in drafting, negotiating, and finalising cohabitation agreements that reflect their intentions and protect their interests, providing clarity and peace of mind as they navigate their domestic partnership.

Post Nuptial Agreements

After marriage, couples may decide that the marital regime that they chose does not adequately reflect their wishes and they may then choose to establish post nuptial agreements to address financial and property matters that arise during the course of their marriage.

We assist couples in creating post nuptial agreements that reflect their intentions and protect their interests, providing clarity and security for their future.

When couples seek to clarify ownership of assets, address financial responsibilities, or plan for the distribution of property in the event of divorce or death, following their marriage, they need a post nuptial agreement.

Our experienced attorneys work diligently to draft agreements that meet our clients’ needs and promote peace of mind in their marital relationship, following their marriage.

Wills

Wills are essential legal documents that allow individuals to dictate how their assets and affairs will be managed after their death.

A will ensures your estate is cared for following your passing.

We offer comprehensive estate planning services, including drafting wills that reflect our clients’ wishes and protect their assets for future generations.

Our attorneys understand the importance of careful estate planning to ensure that our clients’ loved ones are provided for and their legacy is preserved according to their wishes.

Whether drafting a simple will or developing a complex estate plan, our experienced attorneys work closely with clients to create customised solutions that meet their unique needs and goals, providing peace of mind and security for the future.
